I was pulled over last night and my driver window isn't able to be wound down as the switch is broken, the officer said I can be fined for not having working windows. Is this true? If so what law does it fall under?
Queensland's Code of Practice - Vehicle Inspection Guidelines (at Part 3.1: Windscreen and glazing ) include the requirement that:
"At least half of the number of windows fitted, which must include the driver’s window, are not capable of being opened. " (Guidelines available here: Vehicle Inspection Guidelines (Department of Transport and Main Roads))
The Regulations to the Transport Operations (Road Use Management - Vehicle Standards and Safety) Regulation states at section 7 that a light vehicle (i.e. a car) is defective if "...(1)(f) the vehicle does not comply with the Code of Practice - Vehicle Inspection Guidelines....".
Police can issue you with a defect notice (see Defect notices).
