WA When Does Statutory Warranty of Car Start?

Hi There,

Recently I purchased a 2nd hand car from a dealer in Perth. The car is 12 years old and so falls into the 1 Month statutory warranty bracket.

My problem is this:

I bought the car on the 28/09/16 but only collected the car from the dealer on the 5/10/16. The car failed (engine overheat) on the 1/11/16.

Does the 1 month statutory warranty start from the buying date or the pickup date? Because it is the difference between the dealer being liable for the costs of repairs or not.

I would have thought that the warranty period runs from the date of purchase, unless the reason that you couldn't take the vehicle from the dealer until 5/10/16 was due to some fault on their part. I would call the Office of Fair Trading and confirm with them.
