I would like a legal answer if possible, citing the basis for the advice. My question is in relation to someone parking in your car parking spot within a large tier 1 owners' corporation in Victoria. In this case, the car parking spots are owned by the lot owner and are on their title. To access to the car parking spots you need to use common property driveway. There is a boom gate operated by a fob key which is allocated to all owners (who provide the fob to tenants in relevant circumstances) to enter the parking area. The question is whether you can get the car towed away. Thanks

Yes, by a stranger parking in the spot, the owner of the spot cannot park there and, indeed, cannot park anywhere in the car park as all the other spots are owned by other owners.
