I'm looking at starting up a business in Australia for a copyrighted product in the US. Only one company produces them. I was wondering if I had the right to make the same product within a separate new business in Australia in that case.

I just wanted to check that 'copyrighted' is the correct description for the product you are referring to.

Generally, copyright only refers to pieces of original work, such as music, literature, paintings etc. Does the product fall within this category or is it perhaps a patented product or other type of registered design or trademark?

It will be important to clarify exactly what intellectual property rights exist in this product before anyone can comment on the implications for you here in Australia.
