What is the r**e investigation process under criminal law if there is enough evidence against the offender and if the offender is illegally in Australia?

The process for sexual assault offences will be generally the same even though the offender is illegally in Australia. The only difference might be that they flag their passport so they can’t leave the country. These Legal Aid Victoria pages set out information about the criminal offence and the process:
