Homework Question - Budget for Construction Not Disclosed?

Could someone please help me?

Rob was interested in an apartment for sale 'off the plan' with major stamp duty savings. He signed Section 32 and contract of sale, paid a deposit.

One of the special conditions required him to pay 'up to 10% of additional construction costs if the construction was over the building budget. The budget was not disclosed. How can I advise him what to do?
