VIC Get a Divorce After Separation?

Have recently separated from my husband because he was unfaithful. Do I need to have the separation legally recognised to divorce? If so, how do I do this?

You don't need to, but if you don't get a divorce, you'll remain legally married.

You cannot apply for a divorce unless you have been separated from your husband for at least 12 months. For a divorce application to be approved, the court must be satisfied that the relationship has broken down irretrievably.
