Someone filmed me on Snapchat without my consent while we were having sex. I don't know if he saved the video or if he sent it to anyone. The police told me today that as long as he's in the video, he's allowed to film me. He can keep it (if he has it), but not distribute it.

Is this correct? It's contrary to what the police told me originally.

If it isn't correct, can you advise me on how to proceed?

It is a crime punishable by up to 2 years jail in Vic. Summary Offence 41B

Police need evidence before they will act. Will need to be more than your word.

Hi jackiscute,

The police need very little evidence to investigate, your word should be more than enough to investigate. Your problem is they have decided they won't get enough to charge him, so they can't be bothered investigating.

They are now brushing you off.

I suggest you make a formal complaint about their inaction.

Yes, bad wording on my part. They should investigate based on your complaint. They may not charge him though if they feel there is insufficient evidence.

I agree about making a complaint if they do nothing.
