If a case is listed before a federal circuit court magistrate for mention, can they make a final ruling then if they decide, and if not, can I apply to have the case listed as a final hearing?

Hi Kim,

Yes, at a first mention the Court may:
  • give directions;
  • conduct an interim hearing;
  • finalise the application; or
  • fix a date for an interim or final hearing.
The first mention also gives you the opportunity to define the issues in dispute and, where possible, reach an agreement.
