If you haven't attended family dispute resolution, he won't be able to file an initiating application with the court. It takes up to eight weeks or so to get to family dispute resolution, so I doubt you're going to have an issue.

Look, I don't think he'll have much chance. If he hasn't done anything yet.

It would also cost a hell of a lot of money to get a solicitor / barrister to submit to court to get an urgent application to court. And any decent solicitor would tell him that unless he can establish that you're not coming back then he's probably wasting his time.
