Hey,

If final orders are given & a party appeals the orders & further files a stay of the orders pending appeal that due to court's backlog, the stay won't be heard for some 3 months. God knows when the appeal will be!

Anyway, if a condition in the orders isn't followed results with a party's time with the child being suspended "pending further order of the family court ", what would that party's next move be?

Surely it's not in a child's best interests to (through no fault of their own nor the parent for that matter) not see the parent for 3 months?

what sorta access was given in the final orders? What are the grounds for appeal? Sorry your post is a bit vague...

So I'm assuming your ex isn't gonna follow the orders to give you access to the kid.

The primary carer should follow the orders until the appeal is finalised.

And the other parent should lodge a contravention case as soon as the orders are not being followed....
