Hi. If a big branch falls off my tree in a storm, landing mostly in my neighbour's property and smashes part of a boundary fence. Where to the costs lie for tree removal and fence repairs?
An arborist and insurance assessor indicated that we each remove the part of the tree on our own property and share the costs of the fence repairs as it was an act of God.
The neighbour is claiming negligence on my part. But these big eucs randomly shed branches and assume it's part of what we accept in semi rural areas.
