QLD Custody of Children While Ex is in Jail?

Does my daughter need to seek full custody of children when her ex goes to jail in Qld? Does he have any say in the matter if he's in jail? What happens when he gets out if she's had informal full custody while he's in jail?

Only a verbal agreement between both parents at the moment. If he goes away, it will be for extortion.
