Hi all,

We (my partner and I) have filed an Initiating application for interim and final orders and have a first court date Monday of next week. The application was accompanied by a notice of risk.

To date, she hasn't filed a response to the initiating application. What are the chances of getting some interim family court orders next week?

We are seeking 50/50 custody of children of a now 2-year-old (he has full-time care of two other children of a previous relationship.) Haven't seen the child for nearly three months as she has refused visitation after taking out an IIO which allows access if agreed.

What are the normal steps?

We weren't required to do family relationships counselling as they believed it would cause issues. Certificate received to advise that.

If you've ticked the box for interim orders, there's a very good chance they'll be made at first mention, especially since you haven't seen the child in three months.

Don't bank on no response being filed yet. Ours filed a response 12 hours before the first hearing, and the court still accepted it.
