Can you tell me, if you plead guilty to a crime under criminal law because your lawyer has said, "Who will the judge believe, the police or you?" and you didn't commit the crime, can you change your plea from guilty to not guilty?

What stage is the trial at and in what court? Sounds like a question for your lawyer.

Hi Vickie,
The later it is the harder it is and the worse it is.

It needs to be before sentencing.

Rod is right, if you have a solicitor, their advice will be better than a bunch of randoms on the internet, who don't even know the whole story.

If you are gonna do it, do it asap.

Good luck,
Gorodetsky

The first question to ask is, has the formal plea actually been entered?

This issue normally arises on appeal where some one would seek leave to change plea made at trial. It should be noted that courts will only allow change of plea where the accused did not understand the nature of the charge or did not intend to admit guilty. Or, upon facts of the case the accuse could not have been convicted of the offence or any other matters that indicate a miscarriage of justice.
