i have made a Will with NSW Public Trustee as executor. They, The Public Trustee, NSw, has the Will. I wish to cancel that agreement and make a new will through a private solicitor with my son and daughter as executors. Can I do that and how?

Hi Clive,

Yes you can. Any subsequent valid will that you make, will nullify any former will. Go and see your solicitor and get your new will drafted, then just inform the Public Trustee that you have made a new will and that the one they hold is no longer valid.

Do you pay any ongoing will storage fee?

I agree with @Sophea above.

I would add that if you are unable or unwilling to deal with the Public Trustee yourself,
you can also ask your (new) solicitor to write to them, informing them of the new arrangements.
