WA Change in Employment Contract and Superannuation

My construction employer has issued new employment contracts and most seem to be similar to what I get now, just in writing except for superannuation. The employment contract states my normal hours are 40 hours, but I normally do about 50. They increase my rate of pay and pay a flat rate for every hour worked and superannuation. The increase is to cover all sorts, including overtime and leave loading, site allowance, etc. Now they only want to pay 40 hours of superannuation and not pay for any hours over that I work.

It sounds like they have put you a payment arrangement more like a salary. Where you get a set amount every week but you are expected to do reasonable overtime when required. In the case of a salary super is only calculated on your earnings - not actual hours worked.

Wish it was that simple. I work about 50hrs a week, get paid for what hrs I do & then super is calculated @ 9% of what I earn. They want to change it so the rest stays the same but they only pay 40hrs of super. Not sure that it is legal
