Hi,

At what age is it legal for someone to do a cash transaction with someone? Like, sell a mobile phone? I have been told that by Australian Consumer Law it is not legal to do a translation with someone under 18 as they are still a minor?

What exactly are you wanting to do? Are you just selling something on a private level (such as selling a personal item on Gumtree) or are you selling as a business?

Hi Kylie, in most jurisdictions, as you are obviously aware the law does not view a minor as having the legal capacity to enter into a contract, except if the agreement that has been entered into is considered as a necessity. Interestingly though New South Wales is the only State that grants the right for minors to enter into all manners of contractual relationships, provided that the contract that has been agreed to is for their benefit.
