QLD Car Accident - No Car Insurance and Unlicensed Driver

I was involved in a car accident and discovered I was uninsured and the other driver didn't have car insurance or a drivers licence. Both of us believing we are not at fault, and both cars written off, what are the implications of him being unlicensed?

He is in a spot of bother. He should not have been driving and therefore the accident is his fault. It may be mitigated by circumstances (eg you are not allowed to deliberately ram unlicensed drivers).

You are allowed to drive as you have a licence. However you assume the risk in accidents caused by you if you have no insurance.

Trouble is can you get any money from someone with no car, license or insurance. Maybe some kind of payment plan is the best you can hope for.
