Hello. I invested money into a shop. The agreement didn't say I have to work for the shop. Now I'm working in the shop 6-7days a week. I don't want to do it anymore. However, the employer won't let me go, also he's holding my money. I'm afraid he's not going to give me my money back. I lost the receipt and the contract is in Chinese. If I quit, can I get money back under contract law?

Are you a partner, or an employee?
Do you own a share of the business, or was it just a loan?

Jerry,

Nobody in Australia can be forced to work. The days of slavery and forced labour are long gone.

If you do quit, it might depend on what was agreed as to the return of monies.

If you say you are entitled to your money even if you quit, and it is refused, you have three broad options. One - send him a letter of demand. Two - see a Solicitor. And three, issue court proceedings.

Hope that is of some assistance.

Paul.
