Hello....

Just wondering, in Australian Law, if a Notice of Motion can be filed by the respondent if the claimant doesn't perform actions instructed by Assistant Registrar at preliminary hearing? If so, can we request dismissal on the grounds that they didn't do what they were directed to do and for the date to be moved forward to avoid any further delays?

Jasmine, on the basis of the brief outline given, it is possible but somewhat unlikely that dismissal of the claimants claim would occur if it us the only default so far. Hope they help.
