Hi all... I have been caught shoplifting for the 3rd time, first I went with a warning, second I went through diversion and was not charged, now I have been caught for the third time, it was at Coles for $60 worth of food. and the loss prevention officer had called up the police to do a name check on me. They told me they had informed the cops but the cops were too busy to come, so they will let me go, and said the cops will call me at a later time so that I will do some "paperwork". I'm scared that I will be charged for this and then get a criminal record...
It is very stupid of me, to do this again...
I just wanted to know if they will actually call me ?? Is it possible that they can delay this and call me at a later time to arrest/charge me??
I also don't understand why some people just get "fines" for shoplifting , where as I have been charged and had to go through diversion/court in previous time.
Please advise... thank you..

You will be charged and get a criminal record, you were given the chances and you blew it away. You will have a criminal record. You will be lucky if you don't, if I'm wrong and you don't get a criminal record, go buy every lotto ticket!

People get fines as it is their first time and the amount is not material, I think that is why. You are a repeat offender who is not willing to listen or behave, this is the price you will pay.

the only way out of criminal record and end up with other diversion or a fine, if you have solid and good excuse for the shoplifting, like you have no money and rejected from centre link or something like that, what i mean is that your life depended on shoplifting, I may be wrong, I'm sure someone will correct me.

I write this from reading not from experience, I don't think it is worth to shoplift.

A diversion does not carry a criminal record but any other penalty ie fine or bond, does.
Hello Tony,
Please explain what is a diversion, I read couple of times but did not understand it, I know what section 10 is and read it in the Act, I may google it but I think you will be able in put it in plain English for non-lawyers.
Much appreciated.

I have read otherwise, that if you get a fine, you do NOT get a criminal record. you get a criminal record only when you go to court and convicted.
