In a no win no fee injury claim that has been going for some years and now I'm told that I do not reach the threshold for a permanent injury claim - who is liable to pay for all the legal costs?

The Retainer Agreement between you and the law firm, will set out the definition of 'success', which is the trigger for you being liable to pay the law firms costs. I suspect that most Retainers talk about payment of compensation as the definition of 'success', so if no compensation is payable, because you don't meet the threshold, I suspect the law firm bears it's own costs.
