Hi, I was approached at my place of residence today by 2 officers, not in uniform. They said that they ceased a schedule 4 medicine back in December in mail transit with my name and my address. They said that they had a caution and for me to sign it. I refused to sign it and they issued me a notice to appear in court for Possession Of an S4 Medicine. To me, this all sounds very strange. First off, I have no idea what this medicine was hence why I didn't sign it. I know its probably nothing and I just caused a big mountain out of nothing but I just wasn't comfortable with it when I didn't know what it was. Secondly, is this something so trivial and minor that it can be thrown out of court or where do I stand with all this? This all seems weird!

I’m assuming it’s possession of an S4 medicine under the Medicines and Poisons Act (Qld)? If so, the S4 refers to Schedule 4 of the Commonwealth Poisons Standard - which contains a very long list of medicines. You can view the Poisons Standard here: https://www.legislation.gov.au/Details/F2022L00074

This is potentially not a trivial matter. By refusing to sign the caution it appears you’ve made the matter into an issue because you’re now having to make a court appearance.

You should seek advice from a solicitor specialising in criminal matters as soon as possible. Given the situation they may be able to stop things progressing out of hand.
