I'm having an issue with my neighbour - Our house is in desperate need of repairs to a wall that lies right on the property line - we cannot live in the house in it's current state due to water damage. In order to repair said wall, we need to put up scaffolding on our neighbours property (we have tried every other possible method). Our neighbour is making it very difficult/impossible to make this happen despite us accomodating every one of her wishes. We have $20m liability insurance and $20m personal insurance at her request, as does the builder. We have informed her of the amount of time/ dates etc required ( It's about a 1-2 weeks of work). She has made us and the builder agree to paying for a an extra legal contract - that we have had to pay for - $3000. - in case of damages. Isn't this is what insurance is for? She is now asking for $5000 deposit and a fee for every day the works go overtime. Is this legal?
