Property Settlement - Removing an Ex from Property Title?

    My ex partner has willingly signed a Form 1 Transfer to have their name removed from the property title and no money is being exchanged (pursuant to natural love and affection). Do we need to have an additional legal document / agreement drawn up and signed confirming this to lodge with the Form 1 Transfer? This agreement has not been done through Courts / property settlement etc it is just a mutual agreement between ourselves.

    Which State are you based in?

    If you’re based in Queensland, then the DNRM site has some really helpful resources. The Land Title Practice Manual should answer your questions. See section [1-2040], Item 4 Consideration in Part 1-Transfer of the Manual.

    The DNRM staff are also helpful if you contact them about the requirements when lodging a Form 1 Transfer.
