Having issues with a pool builder who is treating us poorly since we asked about the deep end not looking right?!, he took a month to come and check it out then was away on holiday for two weeks and finally answered email and said it is bowl shaped as it costs more for it to be more rectangular-there was never mention of this prior to contract that it was an option needing to be mentioned it asked for.. anyway he then said it would be $20,000 extra to redo. Since then we had picked out the tiles from their chosen supplier, we chose ceramic which is typically much cheaper than the glass mosaic tile option and we were told we could choose any- that they were all included in our contract. We chose some and then a few days later we got a call saying they aren’t in stock in the amount we need so we selected another one for the spa. They were delivered and then a month later the pool builder (company as he doesn’t build the pool at all) said we would have to pay extra to lay the smaller tile in the spa?! Our contract includes tiles and tiling, then he said we had to choose the larger mosaic- as per the contract— we asked him to show this to us and he didn’t, we did not see it anywhere on the contract?! They started tiling and then he sent the bill for $1370 “tile extras” we said we weren’t paying more than the agreed contract total which included laying tiles. So then he sent someone to come and collect ALL tiles big and small, no communication, we did not let them take them, the person that we had never met before started filming and would not leave our property we called the police and they got her to leave with all the other items for the rest of the build but not the tiles. The police also told them that the footage taken could not be used in court as permission to film was not given. Now he is saying that it is in the fine print!? We don’t have any fine print as it was a docusign.. need some advice please!? This is affecting my health with all the stress ongoing for months now. He won’t finish the job and is not answering his phone, he is now threatening legal action “cus we won’t let them finish the job!?) he is full of excuses and lies the whole time. Please help!?
