Hi there,

I have purchased an unit that was subdivided recently.

ie The two units belong to the same owner initially but they did the subdivision shortly before selling them into two separate units. I have purchased Unit 1.

Unit 2 already has an electric gate that is drilled into my wall at the time of purchase and been sold to a new owner...

The two main concerns are:
- The potential long-term damage done to my wall with the electric gate opening/closing constantly
- The gate actually restricts me from accessing my own wall (To set up termite control etc) on the other side of the electric gate via the common property. The gate has blocked my access to a part of the common property as well.

The question is how much am I entitled in regards to this gate? Do I have the right to ask Unit 2's new owner to move the gate back into their own property?

I have attached a diagram just in case. (The hatched lines indicate my wall by the way)
