First up - I will be seeking legal advice, however, I want to hear what people mainly know about this law.

My mother passed away 3 weeks ago. We were living in the house for over 30 years and she has separated with my father around the same time. They never formally got divorced, however, he moved on, got married and had 2 children.

The house or deceased estate is under a joint tenancy and legally, it gets transferred to his name as joint tenants. They never did a property settlement, however, he has practically abandoned us and left us to pay upkeep and all associated bills. I'm not sure if they even legally divorced.

Now if I was to legally try to dispute this and claim half, at least, would there be a possible case or is this basically a waste of money from previous cases people have seen?
