My husband and I are both at fifties and we have decided to end our 7 years marriage due to the fact that he falls in love with a prostitute in Pattaya after recently holiday over there and he now wants to relocate to Thailand for living.

I want to separate for a year before getting divorce as law required. We do not have any children but we do have properties.

Could you please advise me:

  1. Where can I have an application form to end a civil partnership? (I found one but I could not fill the form as our marriage registered outside Australia)
  2. In the case that there is any dispute about properties dividing, do I need evidence about their relationships for my advantage at court? For example: receipt of Western Union that he sent money to her? And many other things like pictures…?
  3. If we come to agree the properties dividing, do I need to get a lawyer involved to do properties settlement or we just process them with bank and mortgage?
  4. If I should do the official properties settlement before he moves to Thailand (about end of May) or I have to wait after a year?

1. Where can I have an application form to end a civil partnership?
I don't think there is one (I could be wrong), what I did I went to Centrelink and submitted a relationship separation form where I stated when the relationship ended, when I moved to my new address, shared bank accounts if any, new asset test etc. etc..
