Jack often walks his dog through the local parklands. The park is maintained by the local City Council. Within the park is a cricket pitch where the game of cricket is played by the local sports club on a regular basis. The Council has designated a gravel footpath approximately 10 meters away from the boundary of the cricket ground for use by visitors walking on the park. One very pleasant summer afternoon Jack is walking his dog around the park. There is a game of cricket in progress and Jack was walking on the grass area very close to the boundary. A cricket ball was struck and Jack was hit on the head. As a result Jack suffered a deep cut and concussion. Jack was in hospital for two days and was unable to operate his machinery at his business for two weeks.


Does Jack have a claim against the Council for negligence?
