Hi,

My wife has not contributed financially to anything in 5 years. I have a property investment in my name which she has not paid anything into. We have 2 children, 5 and 2. She has no superannuation, and wholly and solely relies on my income. I have some super.

What are the entitlements in the event of divorce?

Hi,

Even though your wife didn't contribute financially, they will consider her raising your two children during that time and they will consider her future needs. You need to realise that contributions to a relationship don't have to be financial to see a significant split in assets.

As far as your superannuation is concerned its usually considered a type of property (although superannuation laws apply) and can be divided as an asset. The court will not care that your wife didn't bring in superannuation they will likely consider her an equal party to your superannuation during your marriage.
