Can anyone advise me if I have a right to refuse to work a roster that has be imposed on myself and another worker without negotiation and/or consultation? The roster is unreasonable and has been imposed on us within 24 hrs after we spoke to management about getting paid on the wrong level in the award.

    Von,

In what way is the roster unfair?

If it is being imposed upon you for the reason to do with you raising issues to do with your workplace rights, you may have a right to a claim called a general protections action. Call the Fair Work Commission for further advice.

    Hope that helps.

    Paul.

We have rang fair work and have put in a application with the commission and ombudsman, but the new roster involves travel and work to two other places over 100kms return trip each, where as we have been working in our home town on the same roster since we started 8 months ago. We have decided to refuse to work the new one because no consultation or consideration was given to us about how this impacts on our lives, and have just been told by management, if you don't turn up you don't get paid! Yes, this has happened as a result of us asking about our salary. Both. Myself and the other lady ( we job share) are both in our 50s, have years of experience in the industry and are well liked and competent, mature workers.
