I'm a non-smoker and am forced to share a work van with my boss and another worker who also smokes in the van to go to job sites. This is a daily occurrence and they both smoke frequently every 15 minutes per trip. I lean out the window most days for clean air as I am a non-smoker.

It's a 3-seater van. I have spoken to my boss about this and he said I would have to find my own way to each job site using public transport if I don't like it. What are my employee rights? This has been happening for 16 months and recently I have not been well with a bad cough and a scratchy throat.
