If a lease has been agreed in final form and the lessee signs and sends to lessor's solicitor but lessor and lessor's solicitor refuse to provide a lessor signed copy of lease despite repeated requests to do so, can lessee walk away from lease? bearing in mind lease is for commercial shed and to take up occupancy the lessee would have to move a boat building factory 500kms and there was limited time to do so. When that time ran out lessee sent notice it was not proceeding. lessor responded that lease was signed a week prior but still failed to provide a copy. Lessor continued advertising the property for rent the entire time. Also, once lessor finally provided lease after notice of termination, the Form 20 was not witnessed for the lessor's signature. Lease for 5 years so registrable.
