QLD Can I Demand Return of Gift of Money?

Is it possible to demand a gift of money $5000. back after the receiver has passed away ?

Hi Jacques,

No. Unless the gift money was a loan and specified as such when you gave it to them, you cannot demand gifted money back after that person has passed. The money will form part of their estate and will pass to their beneficiaries accordingly.

Yes I agree with Sarah, unless it was specified to be a loan, it is the property of the deceased and forms part of his or her estate.
