Under Family Law, can my daughter change my grandson's surname on the birth certificate to her surname?

Not without either dad's consent or a magistrates consent.

Correct - even if they are not married and not together. The father has parental responsibility regardless of whether that relationship exists, which means his consent is required for major long-term decisions about the child, including a change of name.
