Hi,

I am a visitor (an adult) to ACT. My question might be a little improper, hence I do not know if it is suitable to ask publicly. If this question in inappropriate my apologies and you may remove this. Anyway, I'd like an answer to this question.

Question: Is it legal under Australian Law to visit pornography websites while in ACT? Additionally, is it legal to use an adult cam to cam webchat in ACT, if we are sure that the other party is an adult?

Websites with AU type designators are generally regulated through the Department of Communications and Arts. Unfortunately this regulation is based on complaints based mechanism. I think the reason this question has had so many views and no responses in over 8 months is because its a loaded question. Can you visit pornography websites? It all depends.

Are you using your own computer because using an employers computer to surf for porn would likely breech their IT policies. What type of porn? obviously the types of porn that would be considered illegal should not be viewed (Child, violent acts, illegal voyeurism, and other unlawful exploitation forms).

Adult cam to cam webchat is a bit the same, only if you know the other party, could you be sure that they are not under age. If its a direct cam to cam chat for your private viewing it would be much the same as the use of a video camera. If however you do it for distribution or if other people can view the content by any means that's a different question.
