Hi Parry,
I don't believe a seller has a legal obligation to disclose this information, unless perhaps if you ask them specifically and they remain silent or deny it. In which case it may constitute misleading and deceptive conduct.

It would be if the seller represented to you that the car was roadworthy, and maybe still otherwise. Not entirely sure.
