Hi, I work for a large company that announced it was closing one of it’s operations late last year. The only official documentation I have received states that my employment would be terminated at the end of March 2020 with a note at the end “to be confirmed at a later date”. Since then they have delayed the closure twice. I now have an opportunity of securing a role elsewhere but when I discussed this with my manager they indicated that I may not be entitled to my redundancy payment if I accept the position. My question is, do I have any legal grounds to challenge this? It seems unfair that they can continually change the closure date and force people to look for other work and then not payout the redundancies.

Might be unfair, but likely legal.

I'd have to see the wording of their notice however suspect you have no grounds for leaving AND trying to claim a redundancy.

Hi Rod, thanks for your advise. I went in to request early release with a different mind set knowing I had to get them on my side if I was to achieve the desired outcome. It ended working out in my favour and I got my redundancy and start a new job next month.
