I have just come across a letter that my father wrote to his brother. There was a will (that my father never saw as his brother is the elder). The family came to Australia in the Depression years and worked to the bone on the land planting vines (my father worked there for 20 years and there was no income from the property then so he went north to work on the mines). The property is now worth millions.

My father got nothing but his brother and sister did. Dad's mother said to him before she died that he would need to make a demand on the estate. Dad told her not to worry, it would be sorted out. But it never was and he got nothing from his brother who has since died.. Now I am a Grandchild and my father has died and the other grandchildren are benefiting from the property, but I haven't.

Can I make a claim on that Estate now, especially as I am in need and now have 2 children myself who should also be benefiting?

Apart from some bizarre situation where you grandfather's estate had not been fully distributed I would say no.

I plan to ask my cousin if he feels any guilt as to why he benefitted and I didn't and I will be asking to see a copy of the Will. If I don't get to see it, and I do not believe it was ever registered, I presume I will have to accept that there is no action I can take ... Thank you for your reponse.
