NSW Will Assault Charge Appear as a Criminal Charge?

Hi all,

Someone who I really care about was involved in a fight in a shopping centre, then was found guilty and was on two years behaviour bond. The charge now is common assault T2. If someone could tell me the following, it would be so much appreciated.

How bad is it? And does it appear as a criminal charge and how can it be deleted from his criminal record, please?

Hi Hellen,

Common assault T2 is pretty bad. Yes, it is a criminal charge. It's going to show up on a police check and it can affect employment to some positions and can impact travel. You can't have a criminal conviction deleted from your record but it does become a spent conviction after 10 years for an adult and 5 years if offence was committed by a child.

A spent conviction doesn't delete the offence but it will limit its disclosure. Basically people wont be able to see it in a basic police check. That said some detailed checks may still show it, such as a working with children check. Sorry it's not good news.
