So here's the short version:

Me and another tenant were on a lease but a domestic happened and he moved out and I got an AVO served on me.

So I moved out a couple of months later as well but paid a break lease fee of $2850. Can I take her to court over half the break lease fee or am I stuffed cause there's an AVO?

Hi Tyler,

You can try, but I suspect the argument would be that she only left (thus breaking lease) because of your actions that lead to the AVO. So it may result in the Magistrate finding in her favour. It couldn't hurt to try, you have more to loose if you don't.
