In our property settlement I agreed to remortgage the house and pay my ex-spouse 90K in our settlement in return for removing his name from the mortgage (originally in both our names). I also agreed to pay for the transfer. I engaged a conveyancer who quoted $400. All my ex had to do was attend the local conveyancers office and sign the paperwork but he told me it had to be done through his solicitor. With 2 days to go before the digital settlement. I received a disclosure statement from his solicitor saying they "estimated" my ex-spouses costs would be in excess of $1000. It seems my exes solicitors have arranged their payment to come out of my mortgage without me agreeing to it or knowing the exact amount. Can they charge me for his costs when I have arranged the conveyancing?
