As the title states, the neighbour next door is a nightmare, all the 15 years he has lived there. We have an automatic gate and when the arm opens the gate it encroaches all of 5mm, yes, that is correct, and when the gate is closed it encroaches 2mm. We have had these measurements confirmed by a surveyor. The gate is on the dark side of his house and it is not a driveway or a thoroughfare. He is now threatening that he will remove the arm and return it to us. Legally, where do we stand? Can he do this for such small encroachments. Yes he is being spiteful. The previous owner agreed to this setup.
