My wife and I are living in our own house.

We privately rent two extra rooms and have both parties signed a simple contract which Flatmates.com provided.

Terms they agree on is Monthly auto renewal with 4 weeks’ notice for both parties.

However, we wish to transform one room to becomes our Son’s room/study room now.

I know it is a period that we cannot evict tenants under some circumstances.

But if the current flat mate:

• Still paying full rent
• Lost the job but did not apply jobkeeper
• Applied jobseeker
• Enrolled a new online course after she lost her job

Are we able to terminate contract with them? If not, when is the earliest time we can terminate the contract?

The current law did not explain if they still paying full rent, can we terminate the contract with them....
