Can a protected person withdraw criminal law charges and still have AVO (domestic violence) held in place against the defendant?

It is up to the police. You can always try to request that they withdraw the charges. However in my experience they never do.

The main reason is due to it being domestic violence. If your matter is not then the chances of withdrawal are greater.

The case is a domestic violence one and the protected are being pressurised into withdrawing the charges. They are being told that we have to hand in some form to have the charges removed.
