I recently won a civil case regarding property boundary matters - fence and retaining wall. I posted queries about it to this forum in the past which helped in achieving the win. I was awarded costs, which were over $ 30,000. However the judgement debtor ( JD ) went overseas months ago and there's no saying if or when they will return. They still own property in Australia.
Can the enforcement proceedure ( as per the Magistrates Act ) still continue in the absence of the JD?
