Hi,
I'm not sure if this is the right forum for me..
Recently my family were made aware that my father may have had life insurance with his superannuation at the time of his death. After going through the process of finding out who the super company were through the ATO, we found that he did have life insurance. This company is now saying that he ceased payments to his life insurance policy prior to his passing but could not provide an exact date, only saying around 2007-2008 and he passed away on the 15th june 2008. His account was also still active up until after his death. They can't give us any reasons why the life insurance would have stopped but haven't been calling us back. They issued us with a statement but it was missing 6 months of his periodic fees.

Does this sound right or you or do you think that we need to seek legal advice?

You should urgently seek legal advice- 3 years is the time limit but you can apply to extend to 6 years.You need to see a Personal Injury lawyer urgently

There is a time limit to claim in each state,imposed by statute.A PI lawyer is one who deals in accident claims and TPD claims

It is an insurance claim but PI lawyers specialize in superannuation death and disability claims

Oh okay thanks for the information. The super company is gathering all the documents they have together and sending it in the mail, so when we receive it we will decide where to go from there.

Hi @caitlin,
Whilst some personal injury lawyers have good knowledge in certain aspects of insurance law related to disability, death, etc., insurance law is its own area of specialisation
I agree that you should obtain legal advice at your earliest opportunity given the period of time that has passed. Which state/territory are you located in?
