I am a sub contractor cleaner, and for the last 4 years the company that I am employed by have been up to 5 weeks behind with my weekly wages. Can he take me to court under employment law if I start working directly for the places that I clean?

Diane, whether you are being paid late will depend on whether you are a contractor or employee. Employee's have protections regarding being paid on time that contractors don't. The ATO has some information on the differences: https://www.ato.gov.au/Business/Emp...yees-or-contractors/?anchor=P27_3519#P27_3519

If you are an employee, you can contact the Fair Work Ombudsman and make a complaint if you are being paid late.

Thank you for your advice, I was unsure where to start the process.
